In the U.S. state of Montana homosexual acts are by a 'law against deviant sexual orientation' (2011!) officially still under sentence and can be punishable by up to 10 years in prison. Although the Supreme Court of the State of this law in 1997 has been declared invalid, removed from the statute books but it was not.
Several attempts by MPs to remove the sodomy law finally failed so far. The Republicans saw it as important that this law - even though constitutionally invalid and therefore not enforceable - are due to its 'symbolic' in the statute books will stay. In the House of Representatives (lower house) the application has to be removed while the law already received a majority in the Republican-dominated Senate (upper house), it is still blocked by the Republicans.
Now there was another initiative to cancel this law that failed due to resistance from the Republicans again. The Judiciary Committee of the State of the application of the Democrats failed to clear 13:7 votes. Similarly, failure is also the request of the Democrats to abolish the death penalty.
